Terms of Service

Agreement

Gymivida is operated by Pyraven Software Solutions. By creating an account, browsing gyms, buying or managing a membership, or otherwise using Gymivida, you agree to these Terms of Service and to our Privacy Policy.

If you do not agree, do not use Gymivida. If you use Gymivida on behalf of a gym or another organization, you confirm that you are allowed to bind that organization to these terms.

The service

Gymivida connects people with gyms, trainers, and fitness services. Gyms list their own facilities, plans, prices, schedules, and rules. A membership is an agreement between you and the gym that offers it. Gymivida provides the platform that lets you find a gym, purchase or manage a membership, book, check in, and contact the gym.

Features can change, and a gym may update its own plans, hours, or house rules. We do not guarantee that every gym, class, trainer, or offer shown in the app will remain available.

Accounts

You must provide accurate account information and keep your login details private. You are responsible for activity under your account. Tell us promptly if you believe someone else has accessed it.

You can request deletion of your account from the app or by following the account deletion policy. We may refuse, suspend, or close an account that breaks these terms, is used for fraud, or creates a risk for other users or for gyms.

Memberships, payments, and freezes

Membership price, length, branch, and included benefits are set by the gym and shown before you pay. Payment is processed by the payment partner used for that purchase. A successful payment is what activates a membership, unless the gym or Gymivida tells you otherwise.

Where a plan includes a freeze allowance, you may pause that membership from the app for a number of days up to the allowance shown on the plan. A plan with no freeze allowance, or an allowance of zero days, cannot be frozen. A freeze is available only on an active membership that is not already frozen, and the requested length cannot be longer than the allowance that remains. When a freeze is accepted, the membership end date is extended by the length of that freeze. Expired or cancelled memberships stay on your profile so you can see them, and they cannot be frozen.

Refunds, transfers, and gym-specific cancellation rules are set by the gym and by the payment terms shown at checkout. Gymivida does not promise a refund except where the law requires one or where the gym or Gymivida has stated one in writing.

Acceptable use

You agree not to:

• break the law, or infringe someone else’s rights;
• misuse check-in, bookings, invitations, or another person’s account;
• interfere with the platform, probe it without permission, or attempt to access data you are not allowed to see;
• upload unlawful, misleading, or harmful content;
• use Gymivida to send spam or to scrape personal data.

Gyms may also apply their own rules on site. Follow those rules when you visit.

Your content

You keep ownership of the text, photos, and other material you submit. You give Gymivida permission to host, display, and process that material as needed to run the service — for example to show a profile photo, deliver a message to a gym, or store a progress photo you chose to upload. You confirm that you have the right to submit that material.

Disclaimers and liability

Fitness activities involve a risk of injury. You are responsible for deciding whether a gym, class, or trainer is suitable for you and for following medical advice where you need it. Gyms and trainers are independent of Gymivida. We are not responsible for their premises, staff, equipment, or the results of a workout.

The platform is provided as available. We work to keep it reliable, but we do not guarantee that it will be uninterrupted or error-free. To the extent the law allows, Gymivida is not liable for indirect or consequential loss, or for loss caused by a gym’s own services. Nothing in these terms limits liability that cannot legally be limited, including liability for fraud or for death or personal injury caused by negligence.

Changes

We may update these terms. When we make a material change, we will update the date above and, where appropriate, notify you in the app or by email. If you keep using Gymivida after the update takes effect, the updated terms apply. Where the law requires your consent for a change, we will ask for it.
